Este jueves la plaza de Marineda City fue el escenario de una concentración convocada por la Unión General de Trabajadores. Zara, el buque insignia del gigante Inditex, era el objetivo. El sindicato ha denunciado que el grupo textil ha despedido a una serie de trabajadoras con “contratos eventuales eternos” tras ser denunciados a la Inspección de Trabajo.
A finales del 2016 trabajadoras de la sección sindical de UGT de Zara empiezan a fijarse en la cantidad de personas que hacen sustituciones, inicios de campaña y períodos excepcionales reiteradas veces. “Lo que hacemos es revisar toda la contratación”, cuenta el responsable del Sindicato de Comercio de Galicia FeSMC-UGT, Álvaro Cajigal, en conversación con Galiciapress. Los servicios jurídicos del UGT corroboran las sospechas. “En esos momentos estamos hablando de alrededor de 60 personas [con contratos fraudulentos], a nuestro entender, y lo ponemos en conocimiento de la Inspección de Trabajo”.
Tras ponerlo en manos de la Inspección, esta solicita los contratos a la empresa y le hace un requerimiento –bajo advertencia de sanción- para transformar 38 contratos de eventuales a indefinidos. Durante este proceso, “se van generando nuevos contratos, y la empresa, como ya sabe por dónde pueden ir los tiros si la inspección le está pidiendo los contratos, empieza a finalizar más de lo normal contratos”, declara Cajigal, y continúan despidiendo a trabajadoras, “contratos que a nuestro entender también son fraudulentos”, añade.
A día de hoy ya han tenido lugar dos actos de conciliación de las siete trabajadoras que denuncian a Inditex –el resto está a la espera por la huelga de Justicia-. Según el responsable de FeSMC-UGT “la empresa reconoce la improcedencia del despido, reconoce el fraude y les ofrece la indemnización por despido improcedente”, rechazada por las demandantes, que buscan recuperar su empleo. También en esas reuniones el grupo textil admite que son “trabajadoras válidas”, lo que significa, siempre según Cajigal, “que las despide porque con los contratos temporales les sale mucho mejor, puesto que son trabajadoras que tienen calendarios distintos al personal indefinido, tienen los peores horarios; trabajadoras que no tienen obligación de darles vacaciones, porque las pueden liquidar al finalizar el contrato; trabajadoras que no generan antigüedad, por tanto la empresa se ahorra dinero y cotización a la SS; y trabajadoras que no reclaman tanto sus derechos por miedo a que no las vuelvan a llamar”.
Los 38 contratos fraudulentos reconocidos por la Inspección de trabajo pertenecen a la provincia de A Coruña, donde se ha convocado, además de la movilización de Marineda City, una concentración el viernes 11 a las 12.00h delante de Zara de Plaza Galicia, en Santiago de Compostela. Con ello se busca la readmisión de las trabajadoras, pero también que la opinión pública “conozca realmente lo que está haciendo la empresa más importante del mundo del sector, dónde está el hombre más rico de España, y cómo trata a sus trabajadores”, para regular la contratación temporal y que no se vuelvan a dar estas situaciones.
En declaraciones a Galiciapress, Álvaro Cajigal acusó a la empresa de seguir con la contratación eventual por motivos económicos. “También me llegan a reconocer a mí en persona que hay más fraude de esos 38 [contratos], algo que yo ya sabía pero que la empresa reconoce. El grupo Inditex está reconociendo que incumple la ley”.
CONTRATOS, JORNADAS Y DESIGUALDAD
“Existe la contratación temporal, pero lo que no se puede es cubrir una necesidad real de la tienda con un contrato eventual”, declara Cajigal, y añade que cuando contratan a una persona inmediatamente después de un despido la empresa verifica que “es un contrato indefinido, pero que hacen eventual y es fraudulento”. “La necesidad real de una persona en una tienda”, añade, se traduce en “un contrato indefinido”.
Pero los recientes despidos y demandas no son las únicas problemáticas del gigante textil. Directamente relacionadas con el tema se encuentran las habituales demandas sindicales de aumentos de horas. “La peculiaridad que hay en este tipo de sector son los contratos a tiempo parcial”, que fomentan la desigualdad entre hombres y mujeres. “Hablamos de un sector que son mayoritariamente mujeres, donde la mayoría la contratación es a tiempo parcial, es decir, ya son salarios bajos, pues más bajos todavía, con jornadas irregulares que no te permiten compatibilizar ese contrato parcial con otro trabajo”, declara Cajigal.
